{"id":1202,"date":"2025-10-13T09:42:38","date_gmt":"2025-10-13T09:42:38","guid":{"rendered":"https:\/\/bufetelatorre.es\/?p=1202"},"modified":"2026-01-10T22:04:43","modified_gmt":"2026-01-10T22:04:43","slug":"delitos-de-estafa-y-doctrina-de-la-autotutela","status":"publish","type":"post","link":"https:\/\/bufetelatorre.es\/es\/delitos-de-estafa-y-doctrina-de-la-autotutela\/","title":{"rendered":"Delitos de estafa y doctrina de la autotutela"},"content":{"rendered":"\n<p>La reciente sentencia de la Sala de lo Penal del Tribunal Superior de Justicia de Canarias de 30 de septiembre de 2025, ha vuelto a poner sobre la mesa la llamada <em>doctrina de la autotutela<\/em>. Seg\u00fan esta interpretaci\u00f3n, <strong>no hay delito de estafa cuando la propia v\u00edctima no adopta las precauciones m\u00ednimas para evitar ser enga\u00f1ada<\/strong>.<\/p>\n\n\n\n<p>En el caso analizado, un hombre transfiri\u00f3 m\u00e1s de 240.000 euros a un supuesto agente inmobiliario sin comprobar la veracidad de las operaciones, repitiendo el patr\u00f3n hasta en cinco ocasiones. El tribunal consider\u00f3 que <strong>\u201ccualquier persona m\u00ednimamente prudente\u201d habr\u00eda sospechado<\/strong>, y que la falta total de cautela rompe el v\u00ednculo necesario para considerar que hubo un enga\u00f1o penalmente relevante.<\/p>\n\n\n\n<p>En resumen, la <em>doctrina de la autotutela<\/em> recuerda que <strong>el Derecho penal no puede protegernos de todos los errores derivados de la imprudencia o la confianza ciega<\/strong>.<br><br><\/p>\n\n\n\n<p>O dicho de forma sencilla: si algo parece demasiado bueno para ser verdad, quiz\u00e1 no lo sea.<\/p>\n\n\n\n<p>Esta doctrina no se restringe solo a la estafa, tambi\u00e9n se aplica por los Tribunales en otro tipo de delitos patrimoniales, como apropiaci\u00f3n indebida, negocios simulados etc. pero es en ese terreno donde m\u00e1s se utiliza, porque pone en juego la frontera entre el enga\u00f1o punible y la simple ingenuidad. Esto <strong>no significa que la v\u00edctima \u201cculpable de imprudencia\u201d pierda siempre la protecci\u00f3n penal<\/strong>.
